On November 21, 2019, Mortenson Taggart attorneys Michael Mortenson and Teresa Alarcon won summary judgment and obtained an award of attorneys’ fees on behalf of Western Digital in breach of contract action before JAMS.
Western Digital was sued for allegedly breaching a commercial contract. Following more than a year of litigation, Mortenson Taggart attorneys moved for summary judgment on the ground that the undisputed facts established that Western Digital complied with all of its obligations under the contract, and no breach occurred. The arbitrator agreed with Western Digital and granted summary judgment.
Having prevailed on its summary judgment motion, Mortenson Taggart then moved for and obtained an award for the payment of Western Digital’s attorneys’ fees and expenses in defending the action.
